Los Angeles is in the final stages of adopting AB 1033. As part of the citywide “Missing Middle LA” initiative, City Planning is drafting zoning amendments that will allow qualifying ADUs to be subdivided and sold as separate condominiums. Once finalized, this will create a new equity pathway for homeowners across the city.

Los Angeles Is Preparing for Backyard Condo Sales
The proposed Los Angeles ordinance will allow newly permitted accessory dwelling units to be subdivided as condominiums and sold separately from the primary residence. Instead of functioning only as rental units, backyard homes could become independently deeded properties with their own titles and resale value.
The framework is expected to prioritize detached ADUs built under updated zoning standards. Homeowners will need written lender consent to split the property, and shared infrastructure such as driveways or utility lines will require formal HOA governance. Junior ADUs are unlikely to qualify.
The pathway is not yet active. While City Planning has been directed to draft amendments and integrate AB 1033 into the Missing Middle LA initiative, homeowners must wait for final ordinance adoption before legally recording a condo map.
Los Angeles is positioning ADU condo sales as part of a broader effort to create small-scale, for-sale housing types without large redevelopment projects. If adopted, this would represent one of the largest urban implementations of AB 1033 in the state.
